In his complaint addressed to the Human Rights Defender of Armenia the advocate informed that the authorities of pre-trial investigative body rejected to terminate criminal prosecution against his defendant for expiry of the limitation periods, and terminated the proceedings criminal case on the basis that his defendant’s consent had not been notarized.
According to the information submitted by the advocate, his defendant is a person with a first-degree disability, is absent from the Republic of Armenia and had been wanted for a number of years, does not currently have a valid passport due to which it is objectively impossible to present a notarised consent to the authorities conducting the proceedings.
In the framework of the discussion proceedings initiated at the Defender’s Office, as a result of joint efforts with the Prosecutor General’s Office of Armenia the criminal persecution against the citizen was terminated, and the proceedings of the criminal case were closed.
