A citizen applied to the Human Rights Defender to restore his/her son's status as a child with disability. He/she informed that the child had a disability since his childhood, was registered in a hospital where regular medical examinations were carried out, but during medical-social expertise, without a revision of the medical documents a decision was made on not establishing a "child with disability" status for the child.
Within the framework of the discussion procedure initiated by the Human Rights Defender's Office, the Agency of Medical and Social Expertise of the Ministry of Labor and Social Affairs organized a double expertise by an extended commission with the participation of relevant professionals of the Ministry of Healthcare. The medical documents were examining and the status of "child with disability" was not established again.
Following the legal consultation provided by the Human Rights Defender's representative, the child once again participated in a medical-social expertise at the relevant commission of the Agency of Medical and Social Expertise and presented new medical documents confirming health issues. As a result, the status of "child with disability" has been established for two years.
