As result of the joint work of the Defender’s Office and the Ministry of Healthcare the issue of receiving a driving license by persons with disabilities has been resolved

With an application addressed to RA Human Rights Defender citizens have raised the issue of not receiving driving license. 

 

The examination of the issue at the Defender’s Office revealed that the issue relates to the Government’s number 1327-N decree of October 18, 2012. It defines the diseases which prohibit a person from driving a vehicle (absence of eye, absence of upper or lower limb, wrist or foot, etc.).  

 

The decree provides the cases of driving a vehicle adapted to the capabilities of the person as exceptions. However, it does not specify what necessary changes the person with physical disabilities should make so the competent authority considers the vehicle adapted to his or her capabilities and issues a driving license.

 

As a result of the joint work a draft composing a supplement to the mentioned decree was developed, which was adopted on the Government’s session on August 31. 

 

It provides solutions necessary to consider the vehicle adapted to the capabilities of a person in order to issue a driving license (for example in case of absence of one eye a vehicle is considered adapted when equipped with special parking system).
