A person sentenced to life imprisonment applied to the Human Rights Defender for receiving dental care by a doctor the applicant prefers and at his own expenses.
The applicant claimed that the same request was addressed to the Penitentiary Department of RA Ministry of Justice several time, however he received the same answers that the necessary medical assistance can be undertaken by a preferred doctor through inviting doctor-specialist to the penitentiary institution by existing procedure.
The applicant refused to receive the respective assistance in the penitentiary institution due to the lack of technical equipment. Moreover, as a result of consultation with his preferred doctor in the penitentiary institution, a dental implant was recommended, which was impossible to undertake in the penitentiary institution.
Considering the application and received clarifications, the Defender made a decision on existence of violation of human rights and freedoms, suggesting the RA Minister of Justice to ensure the right of person sentenced to life imprisonment.
As a result, by the decision of the Penitentiary Department of the RA Ministry of Justice the convicted person was transferred to the preferred dentist, underwent a medical examination and received medical assistance at his own expenses.
